COOKIE POLICY
1. Data controller
Espina & Delfín, S.L. is responsible for the website www.espinaydelfin.com and uses cookies and/or other similar functionality files (hereinafter, ‘Cookies’).
2. What are cookies?
A cookie is a small text file downloaded onto the user’s device when they browse a website, used to store data that can later be updated and retrieved by the entity responsible for its installation.
Cookies can be classified according to the entity that manages them, their purpose, and the duration they remain active.
As such, personal data may be collected—that is, information obtained via the user’s device through data storage and retrieval tools (cookies or others). Personal data refers to information about identified or identifiable natural persons, whose identity can be determined directly or indirectly through an identifier, such as a name, identification number, location data, online identifier, or one or more elements specific to the individual’s physical, physiological, genetic, mental, economic, cultural, or social identity.
Currently, all websites, regardless of the services they provide, use cookies to store minimal information about the user’s navigation on the site.
3. Acceptance of cookies
Espina & Delfín, S.L.’s website displays a notice at the start of the browsing session to inform users about the use of cookies, allowing them to accept their use. Once cookies are accepted, users can continue browsing the website, providing informed consent.
Upon acceptance, Espina & Delfín, S.L. may collect information on the user’s navigation behaviour through a user behaviour tool, using it to improve the user experience and enhance the process of contracting the services offered.
4. Types of cookies used on the website
Necessary cookies: These cookies enable the user to navigate the website and use its essential functions. They do not collect any information about your browsing that could be used for marketing purposes or to remember which pages you have visited.
4.1. Based on the entity managing the device or domain from which the cookies are sent and processing the collected data, cookies can be classified as:
First-party cookies: These are cookies sent to the user’s device from a device or domain managed by the website owner and from which the service requested by the user is provided.
Third-party cookies: These are cookies sent to the user’s device from a device or domain not managed by the website owner but by another entity that processes the data obtained through the cookies.
If cookies are served from a device or domain managed by the website owner, but the information collected through them is processed by a third party for its own purposes (e.g., to improve its services or provide advertising services for other entities), they cannot be considered first-party cookies.
4.2. Based on the purpose for which the data obtained through cookies is processed, cookies may include:
Technical cookies: These cookies allow the user to navigate a website, platform, or application and use its various options or services. They include cookies used by the website owner to manage and operate the website and enable its functions and services, such as identifying the session, processing payments, accessing restricted areas, or sharing content via social networks.
Preference or personalisation cookies: These cookies remember information so that the user can access the service with specific features that may differentiate their experience from other users, such as language, the number of results displayed in searches, the appearance or content of the service based on the browser or region used to access it, etc. If the user actively chooses these features (for example, selecting the language of a website by clicking the corresponding flag icon), these cookies are exempt from the obligations of Article 22.2 of the Spanish Information Society Services and Electronic Commerce (LSSI, for its acronym in Spanish), as they are considered a service explicitly requested by the user, provided the cookies serve only the selected purpose.
Analysis or measurement cookies: These cookies allow the entity responsible for them to monitor and analyse the behaviour of users on the websites to which they are linked, including measuring the impact of advertisements. The information collected through these cookies is used to measure activity on the website, application, or platform, with the aim of implementing improvements based on the analysis of how users interact with the service.
4.3. Based on the duration they remain active on the user’s device, cookies can be classified as:
Session cookies: These are designed to collect and store data while the user is accessing a website. They are typically used to store information relevant only for the provision of a service requested by the user on a single occasion (for example, a list of purchased products) and are deleted when the session ends.
Persistent cookies: These cookies store data on the device that can be accessed and processed for a defined period set by the entity responsible for the cookie, which may range from a few minutes to several years. For these purposes, Opinion 4/2012 of the WP29 stated that, for a cookie to be exempt from the duty of informed consent, its expiration must be related to its purpose. Consequently, session cookies are far more likely to be considered exempt than persistent cookies.
Cookies served from a device or domain managed by the website owner, but where the information collected is processed by a third party, are not considered first-party cookies, since the third party uses them for its own purposes (for example, improving the services it provides or delivering advertising services on behalf of other entities). Accordingly, the website uses non-exempt cookies, both first-party and third-party, such as Google Analytics (third-party analytical cookies), which collect the following data: Device ID and phone number, browser information, and pages visited.
4.4. Cookies used on this website

5. Cookie Walls and the possibility of denying access to the service if cookies are rejected.
Following Guideline 05/2020 of the European Data Protection Board (EDPB) on consent, we inform you that, for consent to be considered freely given, access to services and functionalities must not be conditional on the user’s acceptance of cookies. Therefore, so-called ‘cookie walls’ may be implemented provided that, if the user does not accept cookies, they are still allowed to navigate the website or are offered an alternative means of giving consent, as explained below:
This requirement is particularly important in cases where denying access would prevent the user from exercising a legally recognised right—for example, if the website is the sole means provided for the user to exercise such a right.
There may be specific cases in which refusal to accept cookies limits access to the website or the full or partial use of the service, provided that users are clearly informed and offered an alternative method to access the service without accepting cookies.
In accordance with EDPB Guidelines 05/2020 on consent and the recommendations set out in the AEPD Cookie Use Guide 05/2020, any alternative service must be genuinely equivalent, and it is not sufficient for the alternative service to be provided by a third party unrelated to the website operator.
6. Renewal of consent
We also inform you, in compliance with Article 22(2) of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI): Recipients may withdraw their consent to receive commercial communications at any time by simply notifying the sender of their decision.
Similarly, users may accept, refuse, or withdraw consent for the use of cookies through the functionalities provided by the website operator or through any common platforms that may exist for this purpose.
7. How to disable cookies in major browsers:
It is generally possible to refuse all cookies from a browser or from a specific service. All modern browsers allow users to modify their cookie settings, usually located under the ‘Options’ or ‘Preferences’ menu.
The website of Espina & Delfín, S.L. Provides the following guidance on how to access the cookie settings menu, and where applicable, private browsing settings in each of the main web browsers:
To disable cookies or change your cookie settings, you must access your browser’s settings menu. For your reference, we have provided links to documentation for the most frequently used browsers:

8. Updates and changes to the Cookie Policy
Espina & Delfín, S.L. may update this Cookie Policy from time to time to reflect new legal or regulatory requirements, or to align it with the guidance provided by the Spanish Data Protection Agency.
